We care about protecting the personal information of our customers and visitors, who use the Platform https://bluetik.io/ and the products and services provided hereon (the “Platform”), (collectively, the “Users”, “You” and “Your”). Please read the Privacy Policy (the “Policy”) and the Terms of Usage of the Platform carefully prior to using or registering on the Platform or accessing any material, information or availing any Services through the Platform as these policies specify the manner in which personal data and other information are collected, received, stored, processed, disclosed, transferred, dealt with or otherwise handled and disposed by Bluetik.

By clicking on the “I agree” button or using, registering or signing up for the Solution, You (“You” or “Your” as applicable) accept and undertake to be obliged by the terms and conditions of this Privacy Policy and agree to be contacted by Bluetick to inform You about our products and/or services and/or upcoming benefits offered by us or any of our affiliates or any other sub-domains. This Privacy Policy is incorporated into and subject to Our Terms of Usage (the “Terms”) and shall be read harmoniously and in conjunction with the Terms. All capitalized terms used and not defined in this Privacy Policy shall have the meaning ascribed to them under the Terms.

Team IHA LLP (hereafter referred to as “Bluetik”) offers a suite of messaging software-as-a-service solutions through a single platform to enable its clientele to manage communications with their users under the name and format of Bluetick as a service to its clientele, conducive to their users by furnishing reinforcement via efficacious response and streamlined internal processes.

This policy extends to the Platform and all the products and services offered by Bluetick. Herein, “we”, “us” and “our” refer to Bluetick. It provides the purpose for which we collect personal data, how we use it, and what are Your legal rights in respect to the personal data that we collect, hold, process and dispose.

If You are not yet 18 years old or lack the legal authority to form legally binding contracts under applicable law (or permission from Your parents or legal guardians), we forbid You to use this Platform or Bluetik’s services. We do not solicit or knowingly collect any information from visitors under 18 years of age. If You are a minor and You voluntarily non-comply or submit personal information with the permission of Your parents (or legal guardian), it will be deemed as Your acceptance of this policy and the Terms and this Policy shall be binding upon You.

This Policy is an electronic record in terms of the Information Technology Act, 2000 (as amended/re-enacted from time to time) hereinafter referred to as the “IT Act” and rules thereunder, and, amongst others, is published in accordance with the provisions of the Rule 3(1) of the information Technology (Intermediaries Guidelines) Rules, 2011, which mandates for publishing of rules and regulations, privacy policy and terms of use for access or usage of the Solution This policy is an electronic record, generated by a computer system and does not require any physical or digital signatures.

1. Modifications to the Privacy Policy:

Any information received by us shall be treated in accordance with the applicable laws and regulations of India. It shall be duly noted, that, this Policy is subject to amendment/s based on any business, legal or regulatory requirements and thereupon shall be updated online owing to which we encourage You to review the Policy from time to time for the changes made. We shall make all efforts needed to communicate any significant changes in regard of the Policy to You. Any continued use of the Platform by You after any amendments/alterations/modifications to the Policy shall be deemed to be Your acceptance to the updated Policy.

2. What information DO we collect FROM YOU?

2.1 Collection of Personal Information

Here, the term “Personal Information” encompasses any data that can be employed to identify and distinguish an individual User. This includes, but is not confined to, a User’s first and last name, residential or other physical and virtual addresses, age, gender, such as an email address, contact details, incoming/outgoing messages, business information, products and services You are interested in or require more information about that we might need. Additionally, if any sensitive personal information is in concern, it shall carry the meaning as may be defined under applicable laws from time to time. Further, all such information that You provide to us must be true, complete and accurate and You must notify us of any changes to such personal information.

It is clarified that the Platform only provides for a full stack WhatsApp solution and does not access, process, store or view in any manner that contents of Your conversation and as such, any and all compliance and liabilities associated with Your use of the Platform shall remain with You at all times.

2.2 Information collected Automatically

Some non-personal information is automatically collected – such as Your Internet Protocol (IP) address and/or browser and device characteristics when You visit or navigate the Platform. This does not reveal Your Personal Information but may include device and usage information, such as Your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when You use the Platform and other technical information. This is primarily needed to maintain security and operation of the Platform and for our internal analytics and reposting purposes.

2.3 Like many businesses, we collect information through cookies and similar technologies.

3. What does the information we collect include?

 Device Data:

Data about Your computer, phone, tablet, or other device You use to access the Platform. The following information about Your device may be collected:-

  2. Device and application identification numbers.
  3. Location
  4. Browser type
  5. Hardware model Internet service provider and/or mobile carrier
  6. Operating system
  7. System configuration information

 Log and Usage Data:

This includes service-related, diagnostic, usage and performance information by our servers. Depending on Your interaction, this log data may include: –

  4. Settings and information about Your activity on the website (like associated time stamps and/or pages or files)

Location Data:

The device location can also be collected which can be either precise or imprecise. The extent of such collection depends on the type and settings of the device You use to access the website. For example, we may use GPS and/or any other technologies to collect geolocation data that tells us Your current location (based on Your IP address). 4.1 The primary intention behind the collection of personal information is to identify You and put forward appropriate imperative solutions according to Your needs. This endeavour is aimed at ensuring You receive a customised experience of our products or services suitable for Your business.

4.2 We process such information for legitimate business interests, fulfilment of our contract with You, compliance with the associated legal obligation and Your consent.

5.1 You also specifically agree and consent to Us collecting, storing, processing, transferring, and sharing information (including Personal Information) related to You with third parties such as with entities registered under applicable laws solely for providing Services to You including processing Your Transactions on the Platform. Provided that, the third-party entities shall be bound by contractual obligations to keep such information confidential and use it only for the purposes for which the information is disclosed to such entities.

5.2 We may process or share Your data we hold based on the following legal basis:

– Consent: Given specific User consent for use in a specific purpose as may be required from time to time.

– Reasonable to achieve necessary performance of the Platform.

– For the performance of a contract and fulfilling the terms thereunder with prior notice to the User.

– Where vital interests are involved necessary to investigate, prevent or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities or as evidence in litigation in which we are involved.

5.3 More specifically, You hereby consent that Your data or personal information may be processed under the following scenarios:

Business transfers: In connection with or during negotiations of any merger, sale of a company, assets, financing or acquisitions of all or a portion of our business to another company.

Vendors, Consultants and Other Third-Party Service Providers: The people who perform services for us or on our behalf and require access to such information to do that work. For example, payment processing, data analysis, email delivery, hosting services, customer service and marketing efforts. Unless described, we do not share, sell, rent or trade any of Your information with third parties for their promotional purposes.

Affiliates: This includes our parent company, any subsidiaries, joint venture partners or other companies that we control or that are under common control with us. If we share such information, then in that case, we will require them to honour this policy.

Business Partners: We may share Your information with our business partners to offer You customised products, services or promotions.

Other users: When You share personal information (for example, by posting comments, contributions or other content to the website or interact in public areas of the website) such information may be viewed by all users and may be publicly made available outside the website in perpetuity. Similarly, other users will be able to view descriptions of Your activity, communicate with You within the Platform and view Your profile.

  1. Who will Your information be shared with and the Retention mechanism followed?

6.1 We only share and disclose Your information with the following third parties. If we have processed Your data based on Your consent and You wish to revoke it, please contact us using the contact details provided in the section below titled “Your Consent and Changes to Privacy Policy”. We will delete information based on a request received from You within a reasonable period and latest within 90 (ninety) days of receiving a deletion request. However, we may retain such portion of information and for such periods as may be required under applicable law.

6.2 Notwithstanding anything contained herein, We may retain certain data after the deletion of Your account for reasons including but not limited to the following purposes:

  1. if there is an unresolved issue relating to Your Account, or an unresolved claim or dispute;
  2. if We are required to by applicable law;
  • In aggregated and/or anonymized form; or
  1. We may also retain certain information if necessary for its legitimate business interests, such as fraud prevention and enhancing the safety and security of individuals using the Platform.

6.3 When there is no ongoing legitimate business need to retain such data, we will either delete or anonymise such information, or, if this is not possible (for example, if stored in backup archives), then we will securely store Your personal information and isolate it from any further processing until deletion is possible

6.4 You hereby grant Us consent to share Your information with third parties, as mentioned hereinabove and We shall in no manner be responsible or be under any obligation to inform You or seek additional consent from You for such sharing of information and that the consent obtained hereunder shall operate as a continuous consent till such time as specifically revoked by you in writing.

  1. Cloud API and how is it implemented here?

WhatsApp infrastructure means WhatsApp Enterprise Client deployment which helps communication between users and the Bluetick platform.

7.1 You hereby consent to share all of Your data and information on the WhatsApp infrastructure and all of it shall reside on Cloud API’s (“Data Residence”), a Meta Product.

7.2 You accept that any of Your data previously routed and stored on WhatsApp Infrastructure i.e. for messaging/notification on WhatsApp, shall henceforward be migrated to data centers via cloud API service by Meta.

7.3 You hereby acknowledge that data localization is not offered by the Company for any such data shared or obtained.

  1. How do we keep Your information safe – Security Measures?

8.1 Your data and information are reasonably protected on the Platform through a system of organisational and technical security measures from unauthorised third parties, misuse, loss, disclosure, destruction and alteration.

8.2 Further, whenever You change or access Your Account on the Platform or any information relating to it, We offer the use of a secure server. We cannot, however, despite our safeguards and efforts, ensure or warrant the security of any information You transmit to Us or guarantee that Your Personal Information and/or other Non-Personal Information provided for availing the Services or Platform may not be accessed, disclosed, altered, or destroyed by a breach of any of Our security measures and safeguards, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure. It is further clarified that You have, for so long as You access and/or use the Platform (directly or indirectly), the obligation to ensure that You shall at all times take adequate physical, managerial, and technical safeguards, at Your end, to preserve the integrity and security of Your data which shall include and not be limited to Your Personal Information.

8.3 This Privacy Policy and the security controls and practices implemented by Us to Protect Your Personal Information shall be reasonable security practices and procedures under section 43A of the Information Technology Act, 2000.

Links to Other Third-party Sites and Collection of InformationThe Platform may provide links to other third–party Platforms (“Third–Party Sites”) that may collect Your Personal Information including Your IP Address, browser specification, or operating system. We are not in any manner responsible for the security of such information or the privacy practices or content of those Third–Party Sites. Additionally, You may also encounter “cookies” or other similar devices on certain pages of the Third–Party Sites and it is hereby clarified that We do not control the use of cookies by these Third–Party Sites. These third-party service providers and Third-Party Sites may have their own privacy policies governing the storage and retention of Your information that You may be subject to. This Privacy Policy does not govern any information provided to, stored on, or used by these third-party providers and Third-Party Sites. We recommend that when You enter a Third-Party Site, You review the Third-Party Site’s privacy policy as it relates to safeguarding of Your information. You agree and acknowledge that We are not liable for the information published in search results or by any Third-Party Sites.
  2. Your Consent and Changes to Privacy Policy

10.1 Withdrawal of Consent:

You may choose to withdraw Your consent provided hereunder at any point in time. Such withdrawal of the consent must be sent in writing to help@bluetik.io. In case You do not provide Your consent or later withdraw Your consent, We request You not to access the Platform and use the Services. We reserve the right to not provide You with any of the Services on the Platform upon the withdrawal of Your consent.

In such a scenario, We may delete Your information or de-identify it so that it is anonymous and not attributable to You. In the event, We retain Your information post the withdrawal or cancellation of Your consent, it shall only be for the period permitted under Applicable Law and in accordance with this Policy.

Further, You also acknowledge that the information collected and processed as provided for in this Policy is for the limited purpose of providing You the Services and enhancing Your use of the Platform and such request of withdrawal of consent or deletion of data may adversely impact Your use of the Platform for which We shall not be held liable at any point in time.

10.2 Correcting inaccuracies in the information:

You may correct or update any information online. In the event of loss of access details, You may retrieve the same or receive new access details by sending an e-mail to: help@bluetik.io.

10.3 Changes to Our Privacy Policy:

We reserve the unconditional right to change, modify, add, or remove portions of this Privacy Policy at any time, by notifying You of such changes. Any changes or updates will be effective immediately. Your continued usage of the Platform post such changes or updates will serve as Your unqualified acceptance of such changes or updates.
